In "Manheath Ltd v HJ Banks and Co Ltd" Outer House of Court of Sessions 16 March 1995, it was held that where a contract of sale was subject to a suspensive condition that the purchaser would intimate to the seller, the grant of planning permission before a specified date and no such permission was granted by that date, the purchaser could not waiver the condition.
