QBD 17 June 1996. U alleged that H had provided a negligent valuation report in respect of commercial property on which U had made a loan. Prior to the allegation U served interrogatories on the second defendant (X) to find out how X arrived at the valuation sum. U applied for an order for the interrogatories. "Held" there was a litigious purpose to be served by U knowing at an early stage X`s methodology. Application granted.
