ChD 13 October 1987. Proceedings between the London Residuary Body (L) (landlord) and the tenants of the National Jazz Centre Ltd (N) in respect of business premises at Covent Garden in London . A third party, the receiver (R), asked to be party to the proceedings. In an earlier judgment the registrar had ordered the liquidator of N to give immediate possession to L, despite existence of a winding-up order. The liquidator did not object to the order, but R complained of no opportunity to object. The motion now before the court concerned R`s application to be added to the summons before the registrar and to have the " Blue Jeans " order discharged; L sought its continuance. It was agreed that a Blue Jeans order was not justified unless there appeared to be no defence to the claim for forfeiture of the lease and an order for possession. The lease provides for forfeiture if the rent is unpaid 21 days after due date. Evidence showed N to be over four years in arrears....
