In D & F Estates Ltd v Church of England Commissioners and Others , CA 12 February 1987, the judge allowed an appeal by Wates Ltd , the main contractor builders of a block of flats, holding that the company was not liable in tort to the occupier of a flat for the negligence of the subcontractor plasterers.
