A bank which insists on a warningclause in a second charge on a family home which states that the chargor had been advised firstly of the nature of the what she is doing and further that she has the right to take independent legal advice, and entrusts the execution of that document to a solicitor who was its sole channel of communication, is not liable under the principles of "Barclays Bank v O`Brien".
