QBD 1 December 1995. The water company (N) served a notice to treat on the applicant company (A) and took possession, but no works were commenced. A claimed £22m compensation, six weeks later N withdrew its notice to treat. At dispute was whether N could withdraw its notice after taking possession. Held, that under the Land Compensation Act s31(1) N were entitled to withdraw the notice.
