CA 8 February 1995. Notice to quit by one joint tenant to a landlord is not a `positive act` requiring the joint tenant to consult the other joint tenant`s uder 226(3) of the Law of Property Act 1925 and will thus terminate the tenancy. Those acting in concert with the notifiying tenant are not therefore liabile in ort or impressed with notice of a breach of trust. NB: NO PHOTOCOPYING ALLOWED.
