R v Rent Officer for Camden LBC , ex parte Felix - 1988 - Estates Gazette (1988) EG 119-118(5) .

QBD 5 September 1988 Applications for judicial review by Felix (F) of determinations by rent officers relating to four properties. The first application to the rent officer had been signed by two out of three joint tenants. QBD held that the two who signed were authorised to apply on behalf of the third, but preferred however, to rest its decision on the alternative ground that the evidence justified the conclusion that the agreement made with F was a grant of a joint tenancy to the three, to be followed on the departure of one by a joint tenancy of the other two. Application therefore failed. The second application was signed by one only of five joint tenants. F had received notice and invitation to attend a consultation, but he did not attend. All five tenants attended and the other four joint tenants signed the application. A copy of the amended application was sent to F and an invitation to a fresh consultation.
