CA 8 May 1996. The husband had a protected tenancy, when the marriage broke down the wife remained in the flat with her children but was unable to pay the rent. The main dispute was whether the possession order made against the husband was enforceable against the wife. Held, that under Matrimonial Homes Act 1983 schedule 1 she became subject to payment of rent and arrears of rent but fresh possession proceedings against the wife would need to be initiated.
