In "GA Estates Ltd v Caviapen Trustees Ltd" Court of Sessions 30 August 1991 it was held that where a contract for development of land, freely negotiated between commercial parties, contained a warranty of the fitness of the land for development, the principle of construction "contra proferentum" did not apply to the warranty.
