"Thornfield Roadside Ltd v SoS Environment and another" QBD 17 January 1995. An application to the second defendant for planning permission to build a motorists` service area was refused, the inspector and SoS upholding the refusal on the grounds that in an area of restricted development there was already sufficient provision, with appropriate access and that the application was premature. Appeal refused though the court accepted T`s arguments on prematurity.
