QBD 24 May 1996. The respondent council had granted planning permission for the second respondents to build a hall. The council covenanted not to interfere with light or air passing through any of the windows of the hall. Case concerns whether under Town and Country Planning Act 1990 s237 a council has the right to remove covenants it imposed itself even though the site was being redeveloped. Case decided in favour of respondents.
