LT 17 June 1996. The applicant having obtained conditional planning permission to erect a detached house on garden land occupied by her terraced house sought to have the restrictive covenant forbidding this discharged. The objector lived opposite. His covenant had been discharged uncontested and he constructed a detached house on what had previously been unsightly land. The objector argued that the applicant`s proposal would change the character of the area, lower the value of his property and affect privacy. Application dismissed. Held, earlier discharge of covenant did not set a precedent.
