In R v Milton Keynes DC ex parte Milton Keynes BC QBD 14 June 1991, the application to quash the transfer resolution proposed by the respondent under New Towns Act 1981 S17 to transfer its freehold interest in a linear park to the Milton Keynes Park Trust was dismissed. The respondent is aiming to wind up its statutory duties by March 1992. Held that the respondent was under no legal or statutory obligation to consult the applicant. SOS had been fully informed of the decision and his approval would be required when the proposal was submitted to him.
