In dismissing an appeal by the tenant in Killick v Roberts CA 14 June 1991, it was held that an order for the recission of a protected tenancy because of a fraudulent misrepresentation by the tenant brought to an end a statutory tenancy which had taken effect on the expiry of the protected tenancy.
