Questions the Court of Appeal decision in "Credit Lyonnais Bank Nederland v Burch" where an employee mortgaged her home at the insistence of her employer to extend the company`s overdraft limit. It was held that as a result of undue influence the bank could not make a claim against the employee even though it was her own choice not to take legal advice.
