Harris v Harris - 1996 - Property and Compensation Reports [1996] 72 P&CR 408-414(4) .

CA 24 October 1996. When the respondent`s mother died he was living in the house with his father, by his mother`s will the house was left to the respondent`s two elder brothers, neither of which wished to live in the house. By a Deed of Family Arrangement the interest in the property was transferred to the respondent and his father on condition that the property was not sold but was retained as a family home. The father remarried and on his death his widow, the appellant, commenced proceedings for the sale of the property. The County Court judge said that the property should remain a home for the respondent as long as he wished to live there. Appeal dismissed.
