The construction industry gives rise to more insolvencies than any other industrial sector. The law relating to personal and corporate insolvency has been reformed as the Insolvency Act 1986 and its accompanying rules and regulations. Of the innovations made by the Act, the administration procedure has already been used in connection with construction companies but a claim for wrongful trading under section 214 has yet to be considered by the court, even though the section has been in force since April 28 1986. The purpose of this article is to explore ways in which the section might affect the construction industry. (From journal abstract)
