Midland Bank plc v Bardgrove Property Services Ltd and others QBD 11 October 1990. The court dismissed a claim for costs involved making land stable after subsidence occured as a result of excavation on adjoining land, since the wall erected for this purpose by the defendant developers of the adjoining land had not yet failed. Also the defendants did not owe a duty of care to the plaintiffs on the way they excavated their land.
