PC 10 October 1996. On the death of his father the son succeeded to the land but was not officially named as successor, whereas the grandson was. The son sold the land in 1934 and the purchasor took possession of the land. The defendant was registered as the grandson`s successor, the grandson died in 1962, the purchaser of the land died in 1991. The defendant sought to recover the land from the plaintiffs who were the purchasors` successors. Plaintiffs appealed against the decision that the defendant held legal title. Appeal allowed.
