Associated British Ports v C H Bailey plc HL 22 March 1990. The court allowed an appeal by the tenants since their breach of a repairing covenant resulted in little diminution of value. The landlords sought forfeiture of the lease because of re development plans for the dry dock from which the landlords would benefit if the lease was forfeited but if it were not the tenants would probably require compensation if development went ahead.
