With reference to the ruling in Sheikh v O`Connor (1987 2EGLR 269), this two-part article examines the vendor`s obligation to give vacant possession both under open contract and under a special condition. Part I begins by outlining the case before attempting to show that the vendor`s obligations are actually more extensive than they appear from that case. Part II argues ...."that the obligation to give vacant possession is, "mutatis mutandis", directly analogous to the vendor`s obligation to show a good title free from encumbrances"....
