CA 16 December 1993. Appeal against level of damages awarded over contractor`s failure to complete swimming pool to specified depth. HC ruled that the defect had not diminished value of pool. CA allowed defendant`s claim on the grounds that it was not unreasonable to award as damages the cost of replacing the pool in order to make good the breach of contract even though the shortfall in its depth had not decreased its value.
