In "Fugler v SoS for the Environment and another" QBD 10 March 1993 the appellants has applied for a change of use to a wine bar which was dismissed by a planning inspector on the grounds that the proposed use would increase levels of noise and disturbance to local residents. The appellants appealed and the appeal was dismissed.
