"Cotswold District Council v SoS for the Environment and another" QBD 9 March 1993 centred on the fact that the planning inspector had proceeded on the basis that the `fence` in question was either a windbreak or an enclosure but not both and did not consider what classification it should be given. The appeal succeeded because the inspector did not determine whether the structure was a building and thoroughly identifying it under all aspects of the 1988 GDO.
