Challenge to local plan - allocation of green belt boundaries - two sites - agreement in principle betweeen Council and land- owner to include one site but exclude the other - proposal included in draft local plan- council reversed previously agreed policy - landowner not informed - inspector`s recommendation - modifications to draft plan - council`s failure to notify landowner of change of stance was unfair and prejudicial - the information given to inspector at inquiry was limited - legitimate expectation that council woudl defend the deposit draft - inadequate reasons for modification of deposit draft and failure to hold a further inquiry into the landowner`s objections was irrational and unfair - Application to quash plan allowed.
