Discusses two recent cases concerning breach of duty/ liability in the building industry. In the first case, South East Thames Regional Health Authority v Y J Lovell (London) and Others, a heating and services engineer was found by CA not to be in breach of duty of care following the collapse of a chimney-stack at Guy`s Hospital and in the second case, Richard Roberts Holdings Ltd v Douglas Smith Stimson Partnership & Others (1988) (Abstract 40096) a claim was made against architects regarding liability for defects in a effluent tank .
