QBD 18 November 1988 Action by Mr and Mrs Cross (C) against David Martin and Mortimer (M), a firm of chartered surveyors , claiming damages for alleged negligence in a House Buyers Report and Valuation survey of a house purchased by C. It was contended that M had failed to warn C with regard to three specific defects: ground floor subsidence , misalignment of doors on first floor and the alteration of roof trusses in order to enable the loft to be converted into a room. Damages were measured on the Phillips v Ward principle, the difference between the price C paid for the property and the market value of the property if properly described by M, showing the defects. QBD assessed the difference at £6,000 with interest at 12.25% plus expenses.
