ChD 7 October 1996. By an underlease, B holds a 15 year term of commercial premises from L subject to covenants against alienation. These provide that the tenant may not underlet without the landlord`s consent. On B`s application to underlet, L refused consent on the grounds that the underletting would detimentally harm the reversionary value and that the rent was less than the open market value. "Held" B entitled to a declaration that L had unreasonably withheld consent.
