LT 14 August 1996. Appellant bought an area of land affected by a restrictive covenant, with planning permission for the erection of a dwelling house. He started to build and no-one objected until he received a letter from the council asking for £12,500 to release the covenant. The council later withdrew its objection. Five objectors appeared at the tribunal hearing, contending that the new building would cause a 2% increase in the density of the building scheme. "Held" that although the objectors contentions were insignificant, the application was refused since the house presented a generally cramped appearance which was obstructive in relation to the remainder of the building scheme.
