Shimizu (UK) Ltd v Westminster CC - 1997 - All England Law Reports [1997] 1 AllER 481-501(11) .

HL 6 February 1997. Appellants purchased a listed building with consent to demolish everything except the facades, chimney breasts and chimney stacks. S then applied for listed building consent to demolish internal chimney breasts in order to add an extra floor and extra value to the building. SoS refused the application and S claimed compensation under the Planning (Listed Buildings and Conservation Areas) Act 1990 s27. LT held compensation payable to S by the planning authority. CA allowed an appeal by the plannng authority. HL upheld appeal.
