CA 18 October 1996. E and W entered into an agreement as partners to run an estate agency. By the partnership agreement, W covenanted that he would not practice as an estate agent for 2 years from the date of termination, within two miles of their premises. In May 1995, W left the partnership and obtained employment within the two mile radius. "Held" restrictive covenant not a covenant against competition. Appeal dismissed.
