Discusses "John Lewis Properties plc v Viscount Chelsea" (1993), in which the tenants claimed that their breach of contract to redevelop part of the site was excusable because the existing building on the site was listed after the terms of the lease were agreed. Another issue was whether the landlord had accepted rent when cheques were credited to the landlord`s account even though the rent was repaid to the tenants.
