In Morgan Grenfell (Local Authority Finance) Ltd v Sunderland BC and another QBD 30 July 1990, it was held that under ICE conditions of contract where an engineer issues a certificate omitting certain work the amount is increased by an arbitrator, the contractor is entitled to interest on late payments .
