QBD 10 November 1995. Devon CC made a Definitive Map Modification Order under the Wildlife and Countryside Act 1981, designating a lane on Mr Isaac`s property as a byway open to all traffic. Mr Isaac claimed it was a private road over which the only rights of passage appertained to his land and the owners of two other houses in the lane. TAKEN FROM CASE HEADING.
