In Birmingham City District Council v McMahon and Others , QBD 24 June 1987, owners of a block of flats could not be convicted on an information laid by the tenants alleging that the block as a whole was in such a state as to be prejudicial to health, contrary to the Public Health Act 1936 s92(1)(a) where the statutory nuisance complained of, related only to each flat.
