"Ward v SOS Environment and another" QBD 17/10/94. Applicants owned land which SOS Transport proposed to acquire for Evesham bypass. W applied for certificates of alternative development to the planning authority under Land Compensation Act 1961, s17. Certificates granted. SOS Transport appealed to SOS Environment under s18, stating nil certificates should have been granted for any development other than bypass. Notice was given in each case under article 4 of the Land Compensation Development Order 1974, but W did not receive documents in the time-scale required. Public inquiry held. Judgment for applicants.
