In Haringey LBC v Stewart CA 12 June 1991, the appeal by tenant was dismissed on the grounds having dismissed a claim by a secure tenant against a local authority landlord for breach of its repairing covenants , a judge was entitled to make an immediate possession order under the Housing Act 1985 s85 against a tenant for non-payment of rent.
