In Re Martins` application ,LT 15 October 1986,where a planning agreement imposes restrictions on the use or development of land , the owner may apply to the LT for an order to revoke or modify those restrictions.This case illustrated that such an order may be refused where the restrictions still serve a useful and beneficial purpose.
