In Wandsworth LBC v Singh CA 5 March 1991, the CA upheld the CC decision that a small park was `occupied` for the purposes of Landlord and Tenant Act 1954 s23 by the local authority to whom it was let. As tenant of the space the local authority had security of tenure under the Landlord and Tenant Act 1954 Part II and was therefore entitled to be granted a new tenancy .
