In R v Hackney LBC , ex parte Secretary of State for the Environment QBD 6 July 1989 the application by the SoS that work carried out on two blocks of flats contravened a direction of March 1988 under Local Government Planning and Land Act 1980 that works of new construction above a certain value were not to be undertaken by councils was dismised.The respondents claimed successfully that the work was maintenance not new construction.
