ChD 17 February 1994. The defendant (L) had been a tenant of R but had assigned the lease. In contesting a service charge L claimed that, by the terms of the covenant, their liability ceased when the tenancy was assigned. Deciding for R, "held" that the privity of contract principle and the lease terms `yielding and paying` bound L to pay to sum charged.
