In spite of guidance in DoE Circular 16/91 that planning authorities should assist those wanting to identify planning obligations, the decision in "Daniel Davies & Co v Southwark LBC" was that there was no requirement for objecting solicitors to be informed of the terms of a s106 agreement, where the control of use was involved.
