These cases concern a dispute as to whether the employer, IBM, or their insurers, Pennsylvania, can issue a writ to the architect and main contractors employed by IBM, when IBM sustained losses following problems with the subcontract, and in whose name the insurers can bring action. The parallel action by Pennsylvania was stayed pending the outcome of action by IBM.
