An appeal by the second defendents, the NHBC, against an interlocutory judgment ordering that the council was not entitled to inspection of correspondence between S and their solicitors on the one hand and the insurers and loss adjusters on the other in proceedings for breach of contract brought by S against the NHBC. The issue was what correspondence was capable of attracting `without prejudice` privilege.
