"Pennell v Payne and another" CA 25 November 1994. Held that when a head tenant served an upwards notice to quit on his landlord, the latter was entitled to possession against a subtenant whether or not the subtenancy was granted within the terms of the headlease. "Brown v Wilson" 1949 overuled.
