"Maidstone BC v SoS Environment and another" QBD 28 July 1994. M, owners of land to be compulsorily purchased by Kent CC, argued that compensation should be commensurate with the type of development it had planned to grant permission for: offices, a hotel and a carpark. Though this was upheld by the inspector, his recommendation was overturned by S whose permitted development, the carpark only, was upheld in court.
