CA 22 May 1996. An arrangement by which a waste disposal firm is given access to part of an active quarry for 21 years for the purpose of disposing of waste is held to be a licence, not a tenancy. The court also settles the rent by reference to the space actually filled, not only the amount of waste deposited.
