In R v Exeter City DC and others ex parte J L Thomas & Co Ltd and another, QBD 28 April 1989, an application for judicial review was dismissed with costs to the respondents. The committee were well aware of the consequences of granting planning permission for residential development near to industrial users. It is not improper to grant consent for the use of a site which might cause the user of a second site to move or to cease a use which becomes incompatible.
