The SoS rejected the inspector`s decision to grant planning permission for a superstore development to the appellant, who had offered funding for a link road under a s106 agreement, maintaining that the funding offer was no reason to accept this application or reject other rival applications. Tesco`s appeal that the SoS had failed to treat the funding offer as material consideration was dismissed.
